My sister has been using my old wagon (seeing as I've no use for it, and she needed a car) but due to some previous teenage stupidity cant get insurance for any reasonable sum.
A couple of weeks back someone backed into the front of the car, pretty much tearing the front bumper off mangling it well and truly, and doing a bit of other damage. Thankfully they left a note, and are insured so thats not so bad.
I told her to get it assessed by panelbeaters, but not to accept Thai replica bumpers, and due to this shes been quoted around $1300 to repair the existing one.
My question is - Can the other partys insurance company write off my vehicle if the repair bill is too high?

if they want to write it off just ring the insurance company and be the biggest pain in the ass about it just hassel them qutie offen they do give in more so if its ami. if you have no luck with that just see if they will cash settle and bring it up to me

The other party's insurance company cannot write your vehicle off at all.
All they can do is make you an offer to remedy.
That could include paying for repairs or buying the damaged vehicle off you.
The decision about how much they pay is theirs, the decision about whether you accept is yours.

Thanks for that, the panelbeater seemed to think they could, but I dont know if my sister told them she had no insurance herself.

yes they can its no diffent to if you had ur own insurance and were claming if its not worth fixing they will write it off. becose its not structural you may beable to get a pay out . if they say they want to write it off and you dont want it writng off u have no choice but to with darw the clam and get no pay out. people can add to this post as much as they want saying thats not how it works but every incident like this at work as end it the above
they cant make you write the car off but dont ecpect a pay out. just the same as if it was ur own insurance

The other insurance company is only settling the liability of their customer, they have no contract with you so cannot write off a vehicle unless you agree to it as part of a settlement. If they try to lowball you on repair costs tell them to get bent. You have much more leverage than claiming from your own insurance, for smaller claims they are far better to pay you whatever the quote is than have you drag their client through the disputes tribunal. People get very pissed off and vocal if they get dragged into court for something their insurance was supposed to handle for them.

This is correct.
If the settlement offered isn't to your liking your recourse is against the other driver. It is incorrect to suggest that if you turn down an offer from their insurer you are without options.
