Yeah, that'd be an idea if I was always working late, but it's very rare. I only usually work 9 till 5.30, then I'm off home. The other night was very much a rarity, had shitloads of work on.

Dude, I hate going against the grain of pity here, but you broke the law, whichever way you look at it. Yeah it was nasty of the cop to do it, but from the sounds of it you're lucky he didn't do anything else.

I doubt you'd get off the fine.. you're meant to be responsible for keeping to the conditions of your licence, regardless of being kept late at work. Its' something your boss should be told, and if the job requires you past the time, then thats' your responsibility.. probably gonna get me abused, but I'd actually side with the cop in this one.

Was that rule broken in such a way that the driver was actually going to be a menace to society, no.

There should be some compromise when a situation is looked at. If the cop wasn't being a c**t, he would have got a warning / reminder of the rules. Just watch motorway patrol, people get warned all the time. At the end of the day, the cop was following the rules, but giving a fine for the above offense is a joke in my opinion.

I agree, yes, I broke the law, but I copped the rough end of the deal. I've seen people get off while driving home at 2am in the morning before, while I was only 5 minutes after my restricted time, and 3km away from home.

As I've said though, I'm going to take full responsibility for what happened, if it comes back that I have to pay the fine, so be it. I'm not the sort to go out intentionally after 10pm, but in this case, it couldn't be helped.

Although, at the end of the day, shit happens, life goes on .

Its got nothing to do with being a menace to society (but then, a young restricted driver may not have much experience/confidence driving in the dark, an unlikely long shot yes, but a possibility none the same), its' about you guys expecting a cop to let things slide because.. well, why? You expect them not to do their job to the fullest extent, given the opportunity?

And no Luke, I don't agree with the no-smacking law, nice try though. I fully intend to bring up my children as I was brought up, respect and discipline. Yes that may mean breaking the law, as ridiculous as it is, and I'd be more than happy to accept the consequences and argue my case should the situation ever arise that I'd be prosecuted for it.

I don't expect cops to let things slide, I didn't mean it to sound like that. What I was trying to say is that of all the offenses out there, that get offenders slapped with a wet bus ticket (as they say) this offense doesn't really warrant the fine every time.

I read about a guy that drove drunk, killed a motorist and got 12 months suspended sentence or home detention.... My problem is with the system as a whole. I think more focus should be put on punishing the real criminals out there. Not some dude driving straight home from work on a one off late night at work. How about all the people driving around without WOF and REG with $20,000 in fines...

I pay my fines btw so I don't think cops should not be out there upholding the law. But they can use their judgement on a case by case basis.

Got my reply today, saying the fine won't be waived, due to the fact that the facts shouldve been presented to the officer who pulled me over in the first place, which they were. I don't know if I can really be bothered mailing back again, probably won't do me any good.

Our justice department is royally $&#$%. I don't know how a letter from my boss, a letter from me, and my explaining the situation to the cop in the first place, isn't enough 'explaination' to be able to waive the fine.

That's rubbish. Cops are expected to use their judgement and discression in any given situation, not to follow the law to the letter.

Their job is to "protect and serve" in the same way laws exsist to make society a better/safer place - not act as the govt's revue collection service.

Fact is this cop made a bad judgement call by not taking the circumstances into account. One type of cop we can do with less of.

You could request a court hearing if you really want to go through with it, but if the Judge doesn't like you, you'll be up for Court costs as well

Yup, tis what I'm doing. It's now in the "To Be Paid" basket. It annoys me, but I doubt ill get anywhere even if I did take it to court. The cop has obviously told whoever reviewed my case that he wasn't told the circumstances, which is bullshit, so it's my word against his, not a great start.
