So your $550 quote, Plus the extra 1K, for the extra work?

How does that compare to the $1500 quote you got from toyota?

I read it as being 1k +GST instead of the original price.

Yeah the fine print shouldn't get them out of this one unless they told you about it first, that can't be normal terms of trade...if only I spent more time in lectures all those years ago I might even remember the case law on all this stuff...

im a mechanic.

i cant comment on the legal side of it all, but where i work if we break it, we put it right at no cost to the customer. i think thats pretty standard across the industry.

if its as he says 'common' for this to happen, they should have warned you / included it as a possible extra cost in their quote / estimate.

dont sit still for that shit!

Should be the same deal with any job really. I know if I broke something at work then the customer would not be at fault / out of pocket.

Sounds more and more like they are just trying one on.

Yeah its 1k plus gst now instead of $550 plus gst.

I remember something from case law that the consumer guarantees act don't get excluded if there are terms written down trying to exclude them.

Good idea about grabbing the 6th gear and taking it somewhere else to check for reason for breaking.

I wonder if the gearbox shop is owned by franchises or if it is a single owner. Approaching the owner might be better because the mechs are trying to avoid being held responsible.

the terms will only be enforcable in court if a reasonable person would have had their attention brought to them at the time where the agreement took place. obviously not in this case, it would be different if they had a big sign behind they're counter stating that. comlaw 201 ftw.

in saying that, just because the court will enforce it doesnt't mean the garage will give a toss untill then.

law or not, if you break something of a customers, its your fault, you did it, i find it quite sad they try and charge you for a problem they caused.

Ok back with the car now.
The guy there was persistent on charging me for the work plus the 6th gear+labour which ended up as $1180.
Had a long debate with him about the fact that since they broke it they have to pay for it and his response was that I have to get charged for it otherwise the job I asked them to do cannot be done.
I asked for the manager and he said he was away for holiday (the manager quoted me the price)
I brought out the legal stuff saying that the consumer guarantees act covers these things and that he cannot charge me for it. He then says that he can't do much even with me mentioning the consumer guarantees act as there is no one with the authority to change the price except for the manager (which is away and did not delegate a second person in charge).
Finally he asked me how much I am willing to pay and I said $700 including GST and with final negotiation I had to leave $800 behind.
I won't be dealing with g4ybo factory anymore.

probably better off paying $800 over $1600 or whatever they were trying to sting him for, and getting the car back today and all done/dusted. Alternative being leaving the car there, waiting for the manager, getting into a headbutt fight with the manager and possibly getting away with paying $550.

They're not allowed to hold on to the car even if you don't pay? Or is that an urban myth? For some reason I remember us nutting that out a while back.
