Just out of curiousity what is the charge for dangerous driving, how do they determine between that and careless? and can you use diversion with the charge???? :oops:

I don't know if Diversion will work on Dangerous Driving, but I could definitely be wrong.

In short, yes, but depends on circumstances. It's what happened to me, because the cops are useless and didn't do their job properly I got charged with careless driving but used diversion, just had to go and do defensive driving again :evil:

What happened is I was turning at an intersection, 50km/h area, looked up in percieved danger area (i.e front right), saw nothing, turned, got hit side on by a car that was:

:arrow: overtaking(hence on wrong side of road)
:arrow: travelling at least 90km/hr in the 50km/hr zone!!
:arrow: outside a school
:arrow: over a pedestrian crossing

Causing me to spin and take out some of the footpath, a roadsign, wrote off car etc etc...

And since I was the turning car and should have given way I was at fault, even though the other guy was IMO driving far more dangerously. This leaves me with the question though...if I hadn't turned it would have been a head on and very messy indeed.

Anyway the cops believed the a$$hole when he said he was only doing 60km/hr (they could have measured the skidmarks and EASILY proved otherwise, but no...) I even had an independant witness that said he was being excessively dangerous before the collision, but the cops had to be coerced in to even speaking to him...

So went to the lawyers, they said because it was a civil matter and not criminal (or vice versa) there was no point in trying to get the other guy prosecuted, and the best course of action was to use diversion and do defensive driving again (the course leaders even let me off one of the days because I still remembered it all). No insurance was payed out though as he was uninsured and the car I was driving only had 3rd Party, and when the lawyers told the insurance company that I wasn't [entirely] to blame they didn't pay him anything.

The other guy lost his lisence a few days later for something else unrelated.

So yeah...

*edit: That was for careless, not dangerous so I dont know if you can use diversion on a dangerous charge... I reckon the difference between the two is that when dangerous driving you are doing silly things with intent, whereas careless driving is just being away with the fairies... Also since I was never charged I don't know what the penalty is, I think you go to court and they sort it out there, but because I used diversion I didnt have to go

Um so you were turning right onto a road?? or onto a pedestrian crossing ?? or into the school and i guess the guy must have been overtaking you?? otherwise there would have been another car there for him to have been overtaking - this is only conjecture on my part but unless the police attended the crash (sounds like they didn't) no wonder they didn't really feel the need to talk to the other guy all that much, they still should have as a matter of course but just not a huge here we are we going to grill your ass over this type talk.

Can't get dangerous driving diverted as far as i'm aware careless you can, had a couple of mates done for careless back awhile and they both got off on diversion but the judge (one had to go to court) said if it had of been a higher ie dangerous driving charge he wouldn't have given him diversion.

TOTALLY AGREE WITH U THERE

NZ POLICE ARE LAME AND FUC***UP IN THE HEAD

lets list all the bad thing i seen police do LOL

~i seen TONES of police doing 130kmh on 100kmh zone and i m sure they ar not on duty~ :evil:

~most police dun stick to 2 sec rule, specially undercover they like to tail u and wait to u take off than chase u~ :evil:

~i see young office went off pick up young girls fr high school in their car no those girls ar not in trouble coz those girls was hugging him 8O ~

~there was this time i was filling up my gas in the petrol station and aft i spend like 10 min in the petrol station i turned out and head home around 5 second after i turn out of the petrol station this police pull me over i asked him wats wrong he said i was traveling 70kmh on 50kmh zone just a min ago i was like i was in the petrol station just than if u dun belive me go take a look at the tape in the petrol station ! than he just said no i said u are doing 70 so u ar doing 70 and plus i have u on my meter u see the red one is me green is u or some bullshit like that ~ LOL i bet he was just chasing some other guy but lost them so picked on me !! :evil:

~there was this other time when over 7 cars been broke in to on Princess st auckland UNI ( i was one of them) that asshole that was breaking in to cars starting at like 8 in the morning til 12noon!! there was tones of widness they said they was just standing there and that guy just smash the window and dun even care like 4 police car was after him and the police didnt manage to catch him LOL that guy spend nice 4 hrs searching wats in our car while the police cant do no shit ! ~

so how efficient is NZ police i really wantta knwo !!!

how do you know those girls arent his daughters?

becoz those girls were like 7th form while the office looks early 20's :?
i dun think they are his daughter unless he had them when he was under 10 :D and i m sure they ar not related ~ not if there were imbreed by the way they act ~

another great tool, even easier to use than dictionary.com - the full stop/perioid. Looks like this:

yeah damn fences...... anyway, got some great news yesterday. got a call in the morning saying they wernt going to write my car off hip hip hoooray, and the even better news was that another cop had reviewed my case and decided to lower the charges...not completely sure what to but he said it was the lowest form of charge that he could give me for a situation like mine.

i spun out going round a corner, ended up hitting the curb then going backwards into a fence. wasnt nice, scared the s**t out of me....definatly learnt my lesson.

I was blue car, as you can see green car was far enough in distance to deem safe turning (assuming green car was not travelling faster than 60km/h), (green car was my witness who believed red car was in the wrong, not I), red car pulled straight out to overtake (I had already begun my turn) then pulled back in and hit me. Police did attend, made me do a 3 page long statement, got a couple of sentences of the other guy.

Glad to hear she's not a write off :)

Good luck with the chagres, I've seen the dangerous driving chage in court, was 6 months loss of licience, no biggie. So less than that shoudn't be much to worry about.

Just to verify something. There are people in this world who look alot different than what their age says they are. I have been asked if i was 22 and im 17.. I work in a supermarket and ive ID'd (for buying alcohol) a 35 year old cos i thought he was 18ish. And i wasnt being stupid, i was actually suspicious of his age. Cops arnt all nazis, sure theres the occasional "odd" incident, but theyre out there to protect us (Coming from someone who likes driving fast) and you cant blame them for doing their job.

cespenar, in my opinion you are in the wrong, you failed to give way to oncoming traffic... if you remove the school, and the ped crossing, its blatant ly obvious.... its a nice drawing though... if he hit you in the door, you wouild have been half asleep, taking too much time to do simple manuvours....

if you had stopped at the give way you would have seen the car(if you were looking), if you rolled it you would have gathered enough speed to get through their easily... its not as easy as you think to swerve around a car thats doing half your speed in such a short distance
