Just wondering if anyone is ever received anything like this before?

Dear Sir,

RE: OBLIGATION OF OWNER TO SUPPLY PARTICULARS OF DRIVER/PASSENGER IN RESPECT OF SECTION 118 OF THE LAND TRANSPORT ACT 1998

On Wednesday 21st December 2005 at about 12:10hrs the motor vehicle, registration number ####, which is registered to you, was involved in an offence on The Strand, at the intersection with Gladstone Road, Auckland City. The driver of the vehicle failed to wear a seat belt.

You are hereby given notice to supply such information in your posession or obtainable by you that will lead to the identification of the driver and / or passengers in your car at the time that the above incident occured.

It should be noted that failure to comply with the direction given under the provision of the above Act within 14 days on receipt of this Notice, makes you liable to a fine not exceeding $10000 in a Court of Law and possible disqualification from holding or obtaining a drivers license for such a period as the Court thinks fit.

You can contact me at the above location or alternatively you can e-mail craig.turner@police.govt.nz with the particulars of the driver (full name, address, date of birth, and drivers license number and occupation) and any explanation offered.

Second page is a form to fill in where i'm supposed to write the details of the driver, sign it (by or on behalf of registered owner), and offer an explanation :roll:

Last paragraph:

All details must be supplied within fourteen days from the date of this letter.

On receipt of this information an infingement notice will be sent to the driver. This notice will show the amount of the fine and how it is to be paid.

If the driver's details are not supplied within fourteen days you, as the owner, will the incur a charge of Failing to Supply Information with a penalty of up to $10000

Been in a similar situation myself (allegedly doing 110km in a 50km narrow street, past two cops :roll: )

Seriously, front up by phoning the watchtower at Auckland Central and ask to speak to the Constable concerned.

If need be, do what I did and go in and meet face to face.

All charges were withdrawn in my situation.

Cop thought I was "just another 17 year old kid" with a fast car.

Admitted he was quite surprised when a 30 year old turned up asking for him ! :D

may have been on foot and just taken the rego down.
I once drove home with my alarm siren on (had got water in and went crap...blody unidens)...anyway, an officer came to my home later that evening- he had been on foot and saw me drive past. Asked why I was doing it. After I explained all was sweet...but thats a different situation to yourself.

Well, if it was me, I would just explain that the officer was mistaken, as I always wear my seatbelt without exception. Stick to your story. Pretty near impossible to prove otherwise. Might be a good idea to get into the habit of wearing it though. The more often you get caught without it, the harder it will be to convince them that you always wear it.

but if it went to court it would be your story against the officers...unless there were witnesses
as vvega suggests, maybe talk to a laywer

and IF it went to court youd lose, its like 40/60 in favour of what the cop says as he has taken the Oath saying what ever he witnesses is all true etc etc.

Maybe this is a reason why the cops should get access to email :P

isnt there some new thing of homosexual orientation where if the member of the public saw you doing something wrong they can report it and then you get a letter and you get up to three until they come knocking on your door, could it be something like that? some dick head just reported you for nothing?

Do you even remember seeing a cop at that time? if you dont or if you were somewhere were not likely to be round cops say must be wrong car etc as u didnt see anyone

Say u were wearing a jumper made out of seatbealts that u got for xmas, so the seatbealt blended in so looked like u werent wearing one :wink:

Probably a good idea. Dont write a letter, trust me it doesnt work.

or did he realise u werent a 17 year old kid so thought would drop the charges cause its only fair to sting young ones with speeding =)

haha some of the young ones deserve it but its a lil harsh how cops can be biased towards age and stereotype them, i this modern time of political corectnes would it not be fair to take the cops to court for sterotyping someone on their age? and issuing them with unecessry tikets

There is but its not new - i got a couple of those letters 2 or 3 years ago. Only got 2 so they never showed on my doorstep, but apparently thats what they do. As far as I know they can't do jack about it as it was a member of the public reporting you. In the situation above it sounds like its been a cop whose seen the offence so its different.

might be easiest to pay the fine as most lawyers charge in an hour a lot more than what the fine is for not wearing a seatbelt.

i,ve had several of these. i alwalys write a letter back saying my car was at mechanics/mag & turbo blah blah at the time so could not possibly of been me driving and i never hear anything back. cops are far too busy to be investigating minor crap like this
