Really both parties are partially at fault; if you come up to a roundabout and there is a large truck/bus in the outside lane you common sense says that it is going to partially cut across your lane whilst navigating the intersection because the rear of the trailer will never follow the cab. That is why truckies have to take such wide swings when going around tight intersections. Legally they probably should stick to their lane but in practice it is a physical impossibility.
Personally I'm with MintFX, I always drop back to give them the space they need.
However, IMO the truck driver does have a duty of care to check whether he/she is going to sideswipe a vehicle whilst navigating through an intersection - they too know that they are going to need both lanes and should check that they aren't going to hit anyone while they do so. And they should certainly be aware if they hit another vehicle, it's called being aware of your surroundings.
Not stopping is completely unacceptable.
Still sucks to be you though Pies, it's never good having the hassle of dealing with insurance companies, panelbeaters etc...

Isnt the general rule for most things if it hits your drivers door your in the wrong.
How can there be damage to the left side then?
and if the truck was in front of you shouldnt you have given way...
if this is looked at by the insurance company there is very very very slim to none chance you will be paid out.
ive checked this with the people at work (working at an insurance company and all)
Looks like it was your fault mainly so i dont see the insurance company paying out.
