Postby levin_it_large » Fri Mar 31, 2006 3:02 pm

Well i just got a speeding ticket for doing 61k's in a 50 ... one thing the officer did was incorrectly state the area in which i was stopped... do I have a case at all? i take it I just write a letter and see what happens?

HELBND is very correct, and if you did send in sayin it was written in the wrong area, you will get a reply back saying "Thanks for bringin that to our attention, has now been corrected" and will send a new ticket with the right area on it.

You can always say you werent there so it cant be you, the officers badge number is on the ticket... there is your witness to prove that you werent at the place printed on the ticket, if he said in court that you were there he would be lying under oath. At the end of the day you were still breaking the law and cant expect to be let off, then they would have to let everyone off.
When in doubt, down and out.

Actually, same thing happened to a friend and my uncles a cop. He told us that when the time came to pay simply say. I have proof i wasnt there at the time (Get a witness) the warrent was given. And you wont have to pay for it. Friend stated that with a witness and simply didnt have to pay. So it may be a case by case basis.

may i ask? did you have a radar at the time? because you could have bought one and avoided that ticked for $80 second hand on trademe... now you have to piss away another 80 to avoid the next ticket

keep your eyes open, and your radar on, and the chances are, you wont get a ticket, even if your speeding as often as you can(like me)

my last ticket was over 2 years ago when i lost the suction cups for my detector - go fig

im not reccomending or endorsing to other people my way on the road... but for me it works

Peace

Agreed. You might not have been doing anything dangerous, but you got caught. *shrug*

Just pay the ticket ... its not that much, and its only 20 demerits. You've still got 80 to go, right? ;)

Explain area? Did he put down the wrong suburb or was it an entirely different street?

If it was the correct street and wrong suburb just pay it. If its a totally different street you could contest it saying you were not on x street at such time.

Everyone has the right to a defense, even though the defense may cost you more than the ticket :)

Or alternately save $160 by neither doing over the speed limit, and not having to buy a radar...

Just remember the tolerance around schools within certain hours is now down to 55Km/h in a 50 zone

agreed! I havent had a speeding ticket for about 3 years now, i learned the easiest way is not to speed. Its worked a treat for me so far.

Most people that tend to speed crack me up, they drive like nutters, do crazy passing manovers to end up 2 cars ahaed of me at the next set of traffic lights/intersection etc......

lol, take it on the chin man... the only way you can get off a ticket is if

A. the officers is in an un warrantable condition, which happens more often than you think (check there spotties on the car when you get pulled over at night, if ones out your free!!! ) in saying that you shouldnt be speeding in the first place... lol

B. the officer writes the wrong speed limit on the ticket... Ill have to scan mine one day and show ya's... it seems that the speed limit in ohapau is now 190kph!!??? lol, i got off that one...

But yeah just pay it man, its not worth the hassel chasing it around...
