Shouldn't matter how close you were, if they can't be bothered securing a load properly then they should expect consequences.

most trucks run retreads on there as its cheaper in the long run, the reason they blow out like that is the tyre could have be under inflated witch causes the tyre to heat up and blow apart... or the tyre has be recaped 3 times and the case is is now $&#$%.........
