Speeding Ticket

Postby BzzzzR » Fri Aug 08, 2008 9:05 pm

Hi All,

I was coming back from palmy today, and was getting harassed by some silly driver so I did a quick squirt to get passed (as you do) , and bugger it, a cop got me on laser doing 137ks , Now when he gave me the ticket he said don't look at it now, have a peak when you get home, so I thought great maybe he reduced the speed etc so I get less demerits? BUT when I got home and had a look at the ticket, where you have alleged offense, it had exceeding 100ks and then they are meant to put the fine in opposite this ,but he did not put any fine at all , sooo my question is, since the ticket is incomplete with no fine to pay does this mean the ticket is void, since it is the original I would assume that come 28 days later (or when I send a letter in) there will be no fine to pay therefore no demerit points as how can you enforce payment of a ticket if there is nothing to pay?....Was the copper being a good guy? or did he $&#$% up??

Any input (apart from the usual slow down rubbish) is much appreciated

Did he put a speed in there as well? Or just exceeded 100k? There are boxes near the bottom that have speed brackets and demerit points from memory.

Been there done that, (aye Looonie  ) and it was a drive from Palmy to Auckland too! Hate getting caught overtaking where it's actually safer to spend less time on the other side of the road.

As above, don't pay anything till you get the reminder. I reckon he's let you off, and wanted you to stew about it on the way home so you don't do it again.

theres so much more to competent driving than doing the speed limit.

i've seen many a weaving indicator-less menace doing 80km.

personally i dont have a problem with people doing those speeds or more, in appropriate circumstances.

so heres hoping you got off!

140 isnt that fast. Id easily hit that if i was passing a car and dropped down a gear but i usually do all my overtaking in 5th.

I'd say it is a very nice warning.
I got pinged some years back and the officer reduced the speed from 120 down to 111 and told me to slow down for the rest of my trip.

I'm a little more concious now cos I hate paying fines thanks to his way of approaching the situation.

with the proposed new laws, 125k will be fast enoughf or instant loss...

anyways, on topic, if the ticked has incorrect information, or is incomplete, it is null and void.

I had a ticked a few monthes back, where he put the wrong address on it/not the address i told him... void ticket. didnt have to pay it.

:o Since when? How come this hasn't been publicised?

40k over is close enough, especially if its something stupid like road works where the road works are finished and have been for weeks, but the contractor has forgotten to pick them up, or the signs are hidden behind cars or trees etc. Or they've changed the speed limit on a road you drive regularly & you haven't noticed

So does this mean that my ticket with wrong middle name and my last name was spelt wrong but my car registration. is it void?

No, that's a load of bollox. You'll need a lawyer to get off it, if at all. I've had things like wrong date and time etc, wrong name, wrong type of car etc and they just say 'the officer made a slight mistake' it's still a valid ticket.

If anything on the ticket is incorrect, it is not vaild.
I've heard of motorbike riders getting off tickets because "Kawasaki" was spelt wrong

A "small" mistake is still a mistake, so therefore not legally binding.

Especially for the incorrect spelling of your name. If a judge asks you your name, you are going to confirm who you are and the ticket will be valid.
