Seems very open to abuse by those involved in enforcing the law.

(c) manufactured* on or after 1 January 1985 and first registered in New Zealand before 1 June 2008:
(i) not a vehicle in paragraph (ii) below - 95
(ii) vehicle, with a modified exhaust system, that has either exceeded 95dBA when tested in accordance with subclause 3.1(3), or been prohibited from driving in accordance with a direction under section 115 of the Act regarding compliance with subclause 2.7(5) -90

So if you get stickered in a 1985+ vehicle then you cannot exceed 90dBA, so even if you have an exhaust system that is below the supposed legal limit of 95dBA you will have to fit the stock system to get compliance. Why even have the 95dBA limit in the first place???

Makes sense to me - you are allowed to have an exhaust that is up to 95db and as long as you have it legal from the word go (which is your problem is you don't) then 95db it is.

No it's only until you get stickered, as the police won't have dB meters then it's up to their judgement and therefore open to abuse.

There are enough cases now of police stickering vehicles because they feel like it, and the "not louder than stock" clause allows them to do so. The only way I can see to combat this is to get your exhaust certified before you take it on the road. However that may still not stop some over zealous police from stickering it

Whats the go if u have a conversion?
say a BMW with a nissan motor in it? or a honda with a V8?
Do they go off the factory reading the car came out with or the motor thats been put in the car?

Well, the rules pretty much say you cant have a pod filter, as it says you cannot modify the system to make the BOV louder.

Not that I have a loud exhaust, just interested.

At the moment there is an allowance, however it only kicks in at the LVVTA exhaust cert stage, so arguing with a cop or WOF tester won't help you. As to whether they're keeping it with the new draft, not sure.
