So... last night i found a corolla sitting on my Caldina?!?!

Last night around 7.30pm i was about to leave home when i saw a ae92 hatch parked on the front of my caldina and sitting on the back of my brothers trueno... It had locked up the braked and skidded across part of my property and fallen onto the cars

It must have happened two minutes before i saw it because i had just moved my freshly painted turbo corolla from where my caldina was!!

Whilst waiting for the police a random guy came up and was yarning about the crash and when the cops talked to him it turned out to be his car. he blew twice over the breath alcohol limit and claimed he had nothing to do with it!

Had to have a laugh and so did the cops when they saw all the toyotas at my place and then realised a ae92 hatch was sitting on our cars

Faaark, that sucks man! Does the dude have insurance??

Bring back capital punishment for drink drivers IMO.

Glad to hear you weren't in or around the cars when it happened.

From what I understand, it doesnt matter if HE has insurance or not, they wont pay if hes over the limit (well they MAY, but they'll be chasing him)

Hope YOU have insurance, as they should pay out and chase the other guy.

His insurer won't cover him - he was drunk and shouldn't have been driving = no claim.

Your insurer will chase him personally for the cost of repairs, so make sure it's an immaculate job! :P It won't affect them paying you.

The Insurance Council recommends you do not consume any alcohol before driving a motor vehicle.

All insurance companies will decline a claim where:
* The driver is found to be over the legal alcohol limit, and
* The intoxication contributed to the crash.

nah he isnt insured and neither am i. I was going through insurance for the turbo corolla and my caldina. Caldina was sitting in my driveway so its all just bad luck really.

Trueno was hardly damaged at all!!! its not wof'd or reg'd and never goes anywhere either!!

No insurance = Lesson learnt

I reckon you should have just confiscated the Corolla til the guy pays up for the damage, or sell it to recover costs or something like that.

You could take him to disputes tribunal, and you'd definitely win, but its a pain in the ass.

Most district courts referees won't accept any less than 3 quote for repair, and it then takes about 6 weeks after lodging a claim for it to go to tribunal.

After all that, he probably won't be able to pay right away and you'll be getting $10 a week for ages.

police reccommended giving a quote to them and they would hurry things along. Its all going to go through the courts because of the drink driving. We asked to keep the corolla because it was very straight except for the monched gaurds. Didnt stop the towy doing burnouts in it haha

even if you win... not like it means anything will happen,

iv won before and got nothing

and lost due to dumb judge knowing nothing about cars and not paid
