The sh*t has hit the fan, calling all toyspeed, need help

So you all know that recently I sold my car.... well something bery bad has happened.

For those of you that know the build of the Rs legacy basically i rebuilt the engine/suspension and got new gearbox bla bla bla and then decided to sell it.

So on the auction reads as it did in the for sale section. Well last saterday night a guy rings me up at around 7pm from wanaka saying can he buys the car, I say yeah sure, so he drives to dunedin and gets here at around 11pm (middle of the night). I take him for a drive and during the drive he starts asking me some weird questions like "so all it needs for a wof is some new indicator bulbs right?"... and im thinking, hold on. my auction pages listed a small paragraph of stuff this car needed.... obviously the guy (16 yr old hoody wearing ... u know the type) didnt even bother to read the auction. So After the drive he inspects the car.... its leaked a few drops of oil which he spots and I comment that since its a very fresh rebuild (500 kms or so) this can happen sometimes but that it should go away after a few more kms but that he should keep a close eye on the oil level all the same. I tell him that the car is tuned for 98 and he replys "98 is just shit av gas ill run it on 95 and it will go better".

two days later (monday) he rings me and says that the dipstick for the oil got blown out while he was driving.

He takes the car to a "subaru specialist" in wanaka apparently (didnt know wanaka had these) and he tells him that the cylender rings are blown and that he suspects the car had been overfilled with oil.

Long story short the guy txts me and says he is going to take me to court. Now I spoke with the guy that built the engine and he had it for 4 weeks after the rebuild and it ran perfect. no smoke no funny noises, I had it for a week and it was perfect for me too, just the odd drop of oil every now and then.

So my thoughts are this.

He took the car and raped the shit out of it back to wanaka and cooked it.
He brought a big thing of oil and put heaps too much in and has stuffed it.
He got the boost tap and wound it right up and blew it.

I have spoken with a couple mechanics and they have said that brand new rings dont just fail unless you do sumthing pretty serious to it.

So what I want to know is... do I have anything to worry about?

I got the guy to sign a sales document saying he had inspected the vehicle and was happy with its condition etc but still.....

Any thoughts toyspeed.

Im in the middle of my exams for Uni and I really want to know if I should need to worry or not?

Im no legal beagle, but I would think he has no leg to stand on, especially seeing as he signed a document saying he inspected and was happy.

All private sales are "as is where is". You aren't a registered car dealer, so no warranty. You stated all the condition of the car correctly on the auction. You could be done if you withheld information or misrepresented the car, but you haven't. You'll be sweet.

Tell him running it on 95 is what f*cked it and to pull his head in.
Or... maybe tell him that in a more polite way.

I would say you're in the clear. Was it an as is/where is sale? Doesn't sound like he's the type to have the smarts to follow through with the court threat anyway. I wouldnt lose any sleep over it.

I had the same thing happen with a **wait for it** Legacy GT wagon I sold a few years back. Was going good when I had it although it had no Wof/Reg, it was a 96 and I sold it for $1600, a few days later they come back saying its smoking real bad and CEL has come on. After seeing how the guy drove on his test drive, I basically told them to go suck eggs.

I'd punch him in the face and walk away.
Motorsport is like sex. You could take it to track and have a long, enjoyable session, or you could take it to the strip and get it over with in less than 20 seconds.

the exact agreement that he signed said this.

" I (persons name) acknowledge that in signing this agreement I understand that I am now responsible for all maintainence and care of this vehicle. I also agree that I have inspected the vehicle and am happy with the condition of it".

Signed

If he txt you to say this, rather than ringing you. I doubt he will follow through.
This may just be my age talking, but I doubt a 16 yr old would even know where to go or how to arrange to take you to small claims.
I think that whoever he talks to about doing it(law person, not his mates), will tell him has not a leg to stand on.
The worst you will get from this is some txts calling you a dick or somesuch.....

Just my opinion though

Thinking about it more, I'm sure he just trying his luck. As you say, hes probably raped the shit out of it like any 16 year old with a fast car does, and its crapped out, so though he would try his luck hoping you were a gullible soft prick he may cough up some moneys.

The moment a car is sold with out a warrent it is considered as is where is and that means buyer beware

You gave him the run down, he doesn't have a leg to stand on

Ring his Mum give her the run down and leave it at that

I'd tell him sorry but piss off, he could have done anything to it on the way home.

As long as you didnt mislead him you should be sweet. Avoid small claims court if possible, its an absolute crock of shite, talk to Adydas (cliff) about this regarding a boat a few years ago, he knows the ins and outs.

Although he is a 16 y.o drop kick, sometimes these kids parents are the ones pushing things along, so watch yourself.
