93 Levin VS Pot Hole - levin 0 Pot Hole 1

Heya,

was out with gf racen round tonight and come accross a NASTY pot hole and i t has kinked the inside of the rim by about 30mm's anyone know were i can get it fixed?.

I've heard of someone taking the roading body to court to claim losses and won. Apparantly it's there responabilty to provide an addequte roading system that shouldn't damage your car. Unless you were simply going too fast in the first place.

if u did take action on it by trying to get compensation etc, dont say u wee out racing :wink:

but i rekon u shud try haha, i get so frikin peeved when that stuff happens, hopefuly wont b to much hassle to get fixed

I recall somone having this discussin last year. They damaged their suspension on a pot hole. Cant recall exactly, but I think the were told the council may be liable if it is not repaired 3 days after a complaint/notice is lodged...something like that anyway.

Yeah when it happened to me a few years back I took it to the council who put me onto a roading company who were doing work on the road at the time and should have signposted it better.

They paid out for repairs etc

Wherebouts in Hamilton did this happen? We should all know so we can avoid that pothole in future! :P

theres a panel beaters in cbridge that do it cheaper than anywhere in hamilton, behind the big bp on the main rd into cambridge. ive had 3 rims fixed there good as!

Yeah council is liable to keep the roads to an acceptable standard, if the pot hole is a big as it sounds & could present a danger to road users (think cyclist as well as cars etc) then they are liable for any damage caused. Its the tort of negligence. which basically means its just a common law claim, no specific leglislation.

I had a problem with potholes down here in dunedin & i work for the council, & complained nothing got done, so i slightly exagerated that i almost had a crash on my bike by hitting a pothole, the roading crew were there about 2 hours after i sent of the email filling them in, all it takes is a little exageration & the aura of legal action & they fix it pronto. After a council is just like anyone else & doesnt want a bad name.

If i was you i'd call the council & complain & ask them what they're gona do about ur loss, but as sumone else said, dont say u were speeding. U were just crusing along. 8)
