Personalised Plate Q.
Heres a question that no one can seem to answer.
Selling a car, that currently has a Personalised Plate on it. The car isnt going to be sold with the plate.
The cars rego and wof has expired, so therefore the plate cant be swapped on it.
You need a plate to get a WOF, and Id rather not transfer the cara ownership including my plate to the new person,
Anyone else had this problem before?
I must admit, plates in nz are a pain in the ass.

I think youd find it wouldnt be an issue if you sold it with the minimum 3 months wof and rego your " supposed " to sell a car with.
My mum found the rule out ages ago and wouldnt let up on me about it, but if its correct it would solve your situation beacse the simple answer is " your supposed to make it wofable and regoable by a minimum of 3 months before you can legally sell it "..

im sure you just go to the AA or post shop etc and just get a plate for it.
Been there done that, need a current rego, which means need a current wof....

As is where is means nothing if you really need to push it..
I sold a boat about 2 years ago now, i took it down to the guy who was buying it, and he inspected it to a point he was happy with it.
So effecivly he was happy with the as is where is princapal of the sale, that did Not stop me been taken to small claims court and losing.
its a very long story, but "as is, where is" will not hold up as well as you may think, its not the Magical get out of sale free card everyone belives it to be, and thats coming from someone thats experianced it first hand.

What should I do if the WoF has expired or is more than one month old?
Buyers can insist on a WoF being less than one month old. This helps protect them if faults have developed in the vehicle since the last WoF check.
If the buyer doesn’t insist on this, they should give the seller a written undertaking that the vehicle won’t be used on the road except for taking it for a new warrant of fitness inspection. This protects the seller — it confirms that the new owner is aware that the current WoF is older than one month.
Vehicles without a current WoF must be advertised for sale ‘as is, where is’.
No where on the LTSA site does it say you have to have 3 months of rego to sell.

You don't need a plate to get a WOF! If you just take the plate off and get it in writing that you own it then if/when he gets if WOF'd and Reg'd he will have to get new plates from a TSD.

I tryed finding that as i did hope it wasnt accurate ( who wants there mother to be right ) how ever is it just me or does that seem to emply you can / should ask for at least a months wof? Or does it mean if it has a wof it has to be greater than 1 month ( ie ill only buy the car if you renew it? )
While it says that on the site i still know the harshness of the bite via small claims court, id certainly like to take a memeber of LTSA along as a witness to any such court hearing and have them repeat whats wrote above hopefully defending anyone against any such case.
Even so, it isnt going to change the fact you cant get the personalised plate off unless you have somthing to go on there, and you cant do that untill you have a valid rego ( and therefor wof ).
