p/plate + trademe?

2. The car was sold, but the registration was not sold with the car, meaning that the plate seller isn't legally entitled to sell the plates, no matter what they think.

You can't separate registration from the car. The plates belong to the car, therefore the owner of the car (registration being a non-tangible belonging).

You can separate the plates (rego number) from the car, but the registration is still tied to the car. If the rego number was changed, then they would have recieved new plates to affix to the car.

Take the plates but don't attach to a car for a year until the heat has died down in my opinion. Orignal seller will have no idea where they've gone.

Plates do have a seperate ownership form, but if they're registered to a vehicle its considered part of the car.

Thanks guys! im still alittle confused as to what to do... if i should go threw with the sale or leave it.

Mite have to come to a resolution with each party.. the plates would look good on 1 of my cars. but is it worth the hastle?

2. If Penguin is in fact the owner then complete the trademe sale

3. If Sammy is the owner then walk away... or come to some arrangement with Sammy to purchase them. And contact trademe to have the sale/auction terminated.

alternatively.... get Penguin + Sammy in the same room, get both to fill out the plates change of ownership forms, then throw the $$$ (in $5 notes) into the air and step back to enjoy the c0ck fight

Yeh, and even if under someone elses name they can still be put on anyone's car.
I had HOBAIT on 3 of my cars, and I never changed the ownership of them from the old owner, then when I sold them on, new owner AFAIK didn't change ownership either.

Can get a bit of a hassle when in a situation like this, but yeh.

Whoever is the owner on the personalised plates register doesnt mean a thing, its actual physical ownership of the plate that matters.

Surely the physical ownership means squat when the registered owner could just get them reprinted. If physical ownership were important, then stolen plates could be used.

My opinion thinks that plates can either belong to a person or a vehicle, but not both.

Yep, but you cant use them on a vehicle when its already registered to one So you'd have your plates back, but they'd be of no use until they come off.
You can actually have the onwership passworded so that whoever currently has possesion of them can't have them remade

shit what a mess ive got my self into!

basicly he brought the car with out inspecting it first. i drove it for a few years and it may have been a bit glitchy but it never broke down. he drove up from nelson to pick the car up and didnt bring plates with him- me being the nice guy i am i lent him the plates so he could drive it back to nelson. as you know he wasnt happy so decided to keep the plates.

and bam here we are. im happy to sign over the papers cause i cant be $&#$% pissing around arguing- sure they might still be mine but im happy to cut my losses and end this ordeal.

Why would he bring up plates? It's not the buyers job to change the plates over, you should have done that before you sold the car if you intended to keep them.
