Yes if you speed you are breaking the law, if even only going 0.1kmh over the posted limit. But it comes down to being practical, the old 10% lee way, not the 10k lee way was a good system.
At 50 it meant you could go up to 55 without worrying analy about the speedo, and taking your eyes off the road. At 100 it meant you could go to 110 without having to be an eagle eye on the speedo.
The difference between 104 and 105 is so minuscule, not to mention read (unless you have a digital speedo), it is bad policy to mandate it as the limit, and in my eyes leads to worse road safety, as people aren't looking at the road, they're looking at the speedo.
All the research shows that this is the case when speed limits are rigidly enforced.
The police have tough enough job as it is, without making more of the public dislike them.
Personally I think its a move just designed to soften us up for lower alcohol limits down to 0.5.
