Ticket while fixing car for WOF ??

Car was in for a test last week (WOF has expired) and has a couple
of things that need to be done before I can get a new WOF. Yesterday
the roving Council parking vultures ticketed the car for Failing to
Display etc.

So what is the situation ?? I am correct in thinking that if the car has
been in for a test, and is awaiting parts, that it is legally entitled to
be parked on the road ??

Anyone been thru this before and have a clear answer ??

I think the answer or at least in christchurch is that no you can not park on public road without a WOF even if it just has recently failed.

I know you can get away driving a car to and from a WOF station to get off being pulled over by police.

But by all means write a letter and explain, but i don't like your luck.

yeah i dont think you can argue a case like that, if a cop pulled u over for it on the other hand you could get 28 days to get a wof but i dont think that applies here

Get WOF asap, and right a letter. If they're nice they'll let you off for getting your WOF.

Make sure it's not months after though haha.

I had it happen once, wrote a nice friendly letter, then they start slapping me with the transport act etc etc...don't remember which section, but apparently you can ONLY drive to and from WOF station and mechanic for repairs if you fail. As council sees it, if you parked somewhere public, then you are not going to a mechanic or WOF station....so they didn't let me off. This is Auckland City Council.

My brother in law had the same situation, and didn't get off too, that was Manukau City Council.

Since that time, i just go do WOF 3 weeks before it expires, so more than sufficient time to sort things out if something is wrong.

I got done for the same thing years ago... I got the WOF straight away and they still wouldn't remove the fine.

My suggestion I would get the WOF tomorrow and say that you had to go into town to buy parts to get the WOF and thats why you were there. If you got a friend near where you parked you could get them to write a letter as well backing up your story.

I'd say legally no, as its not legally up to standard with a current WOF which is required for use on public roads. Good luck though

Would be like parking a car on a public road with no reg, but claiming the car never moves. With no reg, its not legally allowed on the road, parked or otherwise.

My 2c you're screwed. You can't park your car places while you have no WoF (well, not on a road etc).

just write a letter once you got the wof explaining the situation. You got nothing to lose. Waitakere council let so many of the people at my work off over the years when they've written in saying they forgot about the wof/rego or the car was getting fixed etc. Worth a try i reckon

I got stung for no rego when I was parked outside the post office paying for my rego, went straight to the council who told me to write a letter, still didnt get off of it. Nelson council there.

Yet my flatmate left her unrego'd un wof'ed car outside our place for a few days, got a ticket, wrote in saying she didnt know the rules and they let her off. go figure

Meh, easy enough to get off. I've had it happen and my mate had it happen too. A well written letter and the fines were waived.
I got off a fine from the council like you, as well as having no rego and getting pinged at a police check point (different occasions).

Get in quick and do it. The longer you wait, the more difficult it will be.

same shit happened to my brother a few weeks back. Flatmate moved his unwarrented car onto the road so she could move her shit out easily and bam ticket!

He rang the council etc and they preffy much said tough luck but nothing can be done

If I wasn't lazy, i'd look it up, but i'm pretty sure you can get a wof upto 14 days early and (so long as you make sure they do it properly) they can date it from when it expires in 14 days time.

Yeah... car is parked on the road outside home... same place it has
been parked every night for the last 8 years. I had to order in some
ball joints which should be here by the weekend. So I will bang them
in and sort the other minors, and go back for the re-test next week.

Photocopy the docs and write a letter. Worth a crack, and if they
don't waive the fine, I'll take it to Court, just to drag it out

On an interesting side note, If you take your car in for a wof 14 days early and it fails the wof, when you drive it out you technically have no warrant and can be ticketed for it, as the new fail overrides the old pass.

if it was parked outside your house awaiting repairs / parts i'd have thought you had a reasonable chance of being let off. just make it clear you havent been driving it, and you have nowhere else to park it.

though different councils seem to have different ways of doing things.

Palmy council let me off for both no wof no reg quoted the act (having worked at Ministry of Justice helped there) and they rescinded both tickets. Mind you that was 20 minutes after failing the wof after finally getting the car going again after 18 months being off the road. I even sent in a copy of the wof sheet showing the date and time of inspection. Ironically the wof sheet was sitting on the dash when they issued both tickets as well

I highly recommend getting your wof done early and I do on my daily, sadly its a bit harder if your car is being built over several months/years.

I got ticketed for parking with no wof while i was parked at the glen eden train station during the day. I wrote in saying i hadn't realised the wof was out as i barely used the car as i caught the train to work and included photocopy of passed wof sheet and i got out of it. It did take 6 months to hear back from them while they" considered" my case
