No. You ALWAYS have the right to take a ticket to court. You simply write to them and request a court hearing.

Nope, I didn't bother explaining I just said can I please have a court hearing date, and please send me a copy of "summery of facts" to my return address.

They didn't reply, then it's $150 + $30 court fees (asshole thing to do on their behalf tbh), and THEN they send a letter "Thanks for writing to us explaining your situation, but yeah, please remember to pay the fine, kthxbai".

I know you're gonna call BS on this one, so I've taken a pic.

I heard a mate of mine that you've been doing bad things, I didn't really see it, I wasn't even there, but I'll give you a fine anyway, and DO NOT CONTEST, because I'll just ignore you and send you another fine with $30 court cost on top anyway, so don't waste your time. Yes the scooter in front of you was doing 20kph and weaving left and right, but that's okay because you're the one in the car with the loud exhaust, so you = wrong.

and GLHF if you have previous traffic fines, even if it dates to more than 7 years ago, they'll use it to their advantage, ie saying in front of the judge "going by your previous records I am not surprised that you've done <insert the things you're accused of>". And then that's another can of worms waiting to be opened

Advice to OP: just pay the fine, you can't really win, I've won ONCE only, and I had to go great lengths. It gets me quite worked up at times, and I might show my emotion a bit too much when it comes to threads like this. But don't waste your time, just pay the fine.

I had the same issue as Akane over a parking ticket. I never recieved the original ticket (whether it was not put on my windscreen or it blew off I don't know).

Time lapsed and it went to court collections. You can get it sent back to the police / courts if you fill in a form explaining your situation. In your case Akane you'd have to send a copy of your request for a summary of facts and outline that you never recieved a response.

It is up to the court as to whether they approve your application or not. In my case they did approve it, and I got Auckland City Council to wipe the ticket.

If you get a issued a ticket but never receive it you need to make sure you had your vehicle registered to the right address at all times or they will tell you to bugger off, lots of people try the "I never received it" arguement while shifting 6 times in 12 months and never updating their address so they tend to push the blame back to the person rather than accepting they may have stuffed up the address they sent to the fine to (which is not uncommon).

Just thinking more about what might have happened with yours Akane, it's possible/probable that a hearing date was set for you in court, but for whatever reason you obviously didn't know / weren't advised of the hearing date, so you weren't there. When you (being the Defendant) fails to appear in minor traffic court, the matter is dealt with by way of Formal Proof, where the officer in charge of the case just signs papers to say everything on the file is true and correct, then the JPs find the case proven and you're ordered to pay the fine (whatever it was for that offence) plus court costs.

That seems to make the most sense, as minor traffic court is in front of JPs not a judge, so it only costs $30 not $130.

You could request a re-hearing if you wanted to, but as you said, you've paid the fine and moved on. :D

What happened was the cop called me at my home number, straight up he asked "Can I speak to <blah>, did you drive on dominion road at <time>", no intros, then scare tactics, won't go in the detail you'll fall asleep with the long story.

But basically I said "just send me the fine I don't want to talk about this further over the phone, it's not going to solve anything".

So he sent me the fine.

First thing I did was wrote in and asked for a court hearing date and summary of facts.

Then that's it, ignored me for 2 months and then send me another fine with $30 on top, then another week went by and said "Thanks for your letter explaining your situation, but we've passed everything to the courts"

It's shit like this mate, shit like this.............

I just say to a cop if they pull me over for running an orange, thanks for pointing that out to me, but seeing this other time I stopped at an orange and the car behind me didn't even attempt to, and caused quite a bit of damage to the car, and gave me and my 2 passengers including my son whiplash, and the police did SFA about it apart from a small fine to the other driver, I no longer will stop at orange lights, as I don't see the point, and neither it appears do other Police officers.

Usually leaves them speechless, and they just give me a warning, well so far with the 2 cops I've been pulled over by since.
Ending up with spare parts in assembling things since 1983

Since it was over two months Akane it gets passed onto the courts. You should have got back onto the lazy mofos within the week asking where it was.

Thats why you courier all important documents so that someone has to sign for it (proof of delivery), I know of a large pest control company who trys to claim they never got any written notice when you try to cancel your contract with them....
