what happens to my car/parts in a write off

Postby dub » Thu Aug 18, 2016 6:37 pm

This has probably been covered but time is short and my search failed. Worried that the rolls might be a write off after a slow nose to tail, can I get my go faster bits back if the insurer takes it away?

Are they are generally less likely to repair a vehicle where modifications may be damaged (ie coilovers, exhaust)?

It depends.

Whose insurer?

Who was at fault?

Were the mods declared?

Where is the car now?

How much is(or was) the car worth?

What is it? Agreed value means nothing 95% of the time.

You can usually buy the wreck back can't you?

You'll need to read your policy to see whether it is agreed value or market value. If it's agreed value it seems unlikely they'll be able to write it off for a slow nose to tail.
Then your only worry is whether the non-disclosed 'go faster' bits give your insurer an excuse to void your policy.

If they payout and write it off you have the option to negotiate the 'wreck' as part of the settlement, otherwise it's all theirs - minus your personal effects.

If the car is in your possession now, and the bits you want can be either simply removed and/or replaced with standard parts, then perhaps do that now before it is assessed.

I thought agreed was agreed, my bro did v. well out of a recent case.

might just roll up to the panel shop with a box of codys and hope they haven't spotted my te37's through the brake dust.

Depends on your insurer's definition of 'agreed'. You'll need to check your policy.

Ideally you would have taken the car home to take all the pieces off first before you let an assessor near it, if it was just a minor nose to tail. I did that with my last MR2. Turned it back to stock, then the insurance company wrote it off and took it away.
