sustained loss of traction

right i was done for sustained loss last night in my diesel hiace, admitted it to the cop etc not trying to blame anyone else so no need to get on the moral high horse etc
was the worlds smallest burnout left no marks etc was like 2 seconds long outside a mates house, and the mufty cop was 100m down the road.

van got impounded for 28 days and iv been summoned to court on the 8th dec

the cop said im unlikely to loose my license due to the fact that both my jobs require me to have a license (electrician and fuel tanker driver) however with the boyracer thing being in the media spotlight at the mo im sure they will try make examples of ppl like me.

my previous driving record is pretty good 1 speeding ticket 2.5 years ago and a red light causing a accident almost 6 years ago.

im planning on getting legal advise etc but what do you guys think will happen?? or any advice on what to say etc cuz yeah if i loose my license i loose both my jobs and possibly my house...... and yeah i know im a dumb $&#$%...

you'll get $&#$% up the ass by the courts. spend $500 - $1000 on a decent lawyer, a limited license is a grand, so if you can pay a lawyer and keep your license then youre better off. try and find a good excuse eg rear tyre is balled or something. and fgs when you appear try and look like youre a geek who wouldnt do a burnout, not a boy racer ;-)

If your driving record is clean, and you were driving a van the cop should have really let you off with a lesser fine or just a warning.

It was wet, in my old mr2 I went fully sideways around a corner, hit rev limiter a few times and got pulled over. Cop saw it was my first offence, I was sincere and he let me off with a warning

Guess it just depends what sort of mood the cop is in

You could also argue that by allowing the wheels to slip you were actually increasing traction.

As far as I am aware they still have to prove that you did something wrong, fortunately the crime you are charged with is worded stupidly and there is no way in this case that it can be proved that your small wheelslip didn't actually IMPROVE traction for that period of time.

the other iffy bit is "sustained" wtf is sustained, define it ffs.

if you admitted it in your statement its probly too late to take that back. it will be typed up and submitted to the courts.

if you look it up online you'll find a list of penalties for each particular charge. if my memory is right they are suprisingly severe for that offence. they usually specify the minimum punishment if convicted. its something like 3months DQ and up to 2 grand fine.

I think when i got charged for excessive acceleration the minimum penalty was worse than drink driving, you would be better off saying you were drunk and lost control of the clutch

Did you admit anything?

You still have a chance to fight it off. You can defend yourself like I did, it's not as hard as you think.

If he's 100m down the road, the chance him seeing a 2 sec burnout (if you're honest with this), and if it was at night, is actually kind of slim.

You might have a chance of winning, but let's not get our hopes up first, you have to lay all the pieces on the table and line them up in the right order, if you play your cards right, you'll get off this.

You call running a red light causing an accident pretty good? Hopefully you get taken off the road for a while so you can think about things for a while

I agree just last week my FXGT got written off by some woman running a red light, and now im out of a car which affects my work. Still waiting on insurance so i get some $$$.

as i said that was approx 6 years ago when i was on my restricted and like 16... all i got done for was the red light not dangerous driving or careless use was a $150 fine and insurance costs.

it was actually like 2 seconds 3 tops.

when he pulled me over he said "why do you think i pulled you over"

i answered " probably because i did a wee burnout back there" or words to that affect, so yeah i pretty much admitted it straight up......

some info i have is that the sustained loss of traction is base on the "display" rating. no "display", charge cant be applied. you just have to prove it.
was your mate around? laughting and pointing and doing thumbs up? if you wernt doing it as a display to get attention, it could be played as accidental. as said, wet, in a torquey diesel-light-in-the-rear van. recipe for "accidental".

Research the likely penalties. Pleading guilty is probably going to be cheaper than defending it... although it will probably affect your insurance premiums in the future.

yeah there was a few people around prob like 20 odd.

my initial thinking was fess up, apologise, say was a error in judegment and hopefully not loose my license. but i think the reality of that is ill loose it anyway.

, where if i plead not guilty and get a few of the guys that were there to to come to court and say it was similar to a granny in a supermarket spinning up etc, and the face it was cold had been sitting 2 outside his house for 2 days so there was alot of exhaust smoke etc i might loose it but i might not too.

should have thought about it more and said nothing at the time. balls.

just did some quick research, if i get convicted

"the court MUST disqualify the driver for a minimum of 6 months"

there is no way in hell the that pathetic skid justifies loosing my license for 6 months. 6 minutes maybe even 6 days no way 6 months......

yeah thats sounds about right, as i said, better to say you were blind drunk and couldnt control the clutch
