ok so heres the pics people have been asking to see...

happened first thing last friday morning (17th - the day after my 22nd birthday!).

coming thru a 2 lane round about the truck on the outside lane decided he was going to be lazy and cut across into my lane. i slammed on the brakes and was hit by the rear wheel on his rear trailer (was a 2 trailer truck from memory) and knocked up onto the roundabout. its not like there wasnt enough room for him to go round the rounadabout without cutting across but yea. i guess he just didnt see me.

driver didnt stop but i got the number plate of his trailer and reported it to the cops that morning. im still waiting to hear back from the cops about it.

with a bit of luck insurance will pay up and i may end up keeping it. who knows.

must have been a day for trucks was going down to hams on friday and there was a car truck just past newmarket and then another one heading north further down and i would not have wanted to be the driver of the honda that was stuck sideways across the frount of the truck

in that case nail the truckers ass!
he should get a few fines: failing to stop at the scene of an accident, failing to report an accident?, failing to keep within his own lane, maybe dangerous or careless as well to top it off

well if i was you id be pushing for the cops to burn him on everything they can!

can ya get any non accident damages fixed up and say they were part of it? (if there are any?)

can we ask what company it was?

if it was the second trailer of a two trailer truck, I suspect he wouldn't have had a clue that he had hit something.

Looks like a fairly straight forward fix. Pity he didn't run over the front of the car, as you would have got a nice insurance pay out then, and could look for one of those Soarers you want.

its not that we think we own the road, its that its VERY hard to negotiate some intersections without crossing lanes, in case you hadnt noticed, trucks are wide, and long, and require more room to manuvere than your average fxgt.

and its very conscientious of you to give room, im sure the drivers appreciate it. 8)

i hope you get done for sustained loss of traction doing a u turn and excessive acceleration leaving the traffic lights some time, you really deserve it with an attitude like that.

Firstly, it was an accident, and odds are he wouldnt notice it, quite often while cornering you cant see the back of your trailers, and an an mr2 glancing off the side of a b or a train would feel like a small bump in the road.

Secondly, You are endorsing fraud.

You can either drive a truck on the road.. or you can't.


There is no part of the roadcode that says a truck or any vehicle can change lanes willy nilly without indication. Especially on a roundabout.

All you guys are soooo hard done by... waaahh, my trucks too big for me to drive safely and legally so I'll smash everyone elses cars and drive at 120km's on the road cos I'm bigger and wont get hurt.


Just quietly... I think it's horseshit. :wink:

Surely it is up to the truckie to know where their truck is placed on the road in relation to other vehicles...

Really both parties are partially at fault; if you come up to a roundabout and there is a large truck/bus in the outside lane you common sense says that it is going to partially cut across your lane whilst navigating the intersection because the rear of the trailer will never follow the cab. That is why truckies have to take such wide swings when going around tight intersections. Legally they probably should stick to their lane but in practice it is a physical impossibility. Personally I'm with MintFX, I always drop back to give them the space they need.

However, IMO the truck driver does have a duty of care to check whether he/she is going to sideswipe a vehicle whilst navigating through an intersection - they too know that they are going to need both lanes and should check that they aren't going to hit anyone while they do so. And they should certainly be aware if they hit another vehicle, it's called being aware of your surroundings. Not stopping is completely unacceptable.

Still sucks to be you though Pies, it's never good having the hassle of dealing with insurance companies, panelbeaters etc... :?

but yes, you are right, all road users have the same duty of care to prevent an accident.

yeah, the situation sucks, and im not saying it was pies fault, just trying to educate those who are anti-trucks in the thread. good luck with the repairs, hope insurance doesnt mess you round

actually there are cases where trucks and bus's and other large vehicles may use extra lanes when maneuvering,

I cant remember exactly when, but im sure its in the road code.

ok first off im not here to cause arguments, i am actually really courteous of truck drivers on the road - i give plenty of room, and im not one of these arses that love to sit right up a trucks arse

FYI: my car is 4wd and i dont think ive ever had a 'sustained loss of traction' in it, im not that stupid :P

main thing i was pointing out is the fact that there are a few really arrogant truckies, but there are more good ones than bad
i do a fair amount of open road driving daily so i see first hand how some of them act
they do need to be more aware, especially in town, but other motorists (some more than others!!) also need to be aware that trucks are bigger, slower and take more room to manoveur (sp?)

it sucks to be Pies because his car is now bung, and im sure youd be pissed if someone (essentially) did a hit-and-run on you or one of your mate's cars

i realise it was kinda stupid of me to be next to a truck at a round about but really... if you have seen the rundabout you will know that it is plenty wide enough for 2 trucks to go through side by side!!

thats not the point anyways. the point is, he cut into my lane, using around 95% of my lane forcing me onto the roundabout.

i didnt get a company. all i saw was the blue rear end of the trailer

dont get me wrong i usually have alot of respect for truckies on the road. i wont harass them or anything like that cos im sure they get enough of it from everyone and leon is right, im sure he wouldnt have felt an mr2 under his wheel of the back trailer!

i just want someone to pay my excess cos i cant afford it. i dont want charges or anything laid cos what happened was a simple mistake. how many of you guys have never cut across a roundabout huh? just turns out this time a small, hard to see, mr2 wasnt quite far enough behind the truck not to get hit!

no one else stopped either. which kinda makes me think that it wasnt that obvious that i got hit. but all the same, i did get hit and all i want is my mr2 back on the road!

im going to get the panel beater to fix a few things up while its there but at my own cost... not the insurance company

If he was in the outside lane that means hes on the right of you...

Isnt the general rule for most things if it hits your drivers door your in the wrong.

How can there be damage to the left side then?

and if the truck was in front of you shouldnt you have given way...

if this is looked at by the insurance company there is very very very slim to none chance you will be paid out.
ive checked this with the people at work (working at an insurance company and all)

Looks like it was your fault mainly so i dont see the insurance company paying out.
