Driving Infringement

Postby eViLoNe » Fri Sep 26, 2008 11:46 pm

So, I got done for after hours driving, 5 minutes after 10 and 2 minutes away from my house, shit happens.

The thing is, the cops put my address down as 55, not 54, is that decent enough to send a small wee form of correspondence to the correct people, or just take the fine, and pay up?

I'm a bit pissed off about it, mainly because I was heading back from a late shift at work that was unexpected, but hey, if I end up having to cop it, I do.

a small mistake like the address number being wrong in no reason to get off.

however the 5 mins is imo....
if your telling the complete truth I would write a letter in asking to be let off.
get your boss to include a letter confirming you were working late.

Man that cop must of been in a bad mood to ticket you for being 5 minutes past. You will most likely get off it.

Yeah, I figured as much, just thought I'd throw it out there.

That's an idea though, it's a bit rough. I got pulled at 10.05pm, the ticket says 2215, but that's still close enough to 10 in my opinion.

I'll have a word to my boss on Monday and try and suss something out.

Yeah, well, he claimed I was speeding down a small road where he actually had some Subaru driver bailed up (and towing his car ), when in reality, I didn't speed at all, I was actually under 50km/h when he told me to pull up, and I hadn't even had to brake to slow up. Load of shit.

Oh well, if I have to pay, I have to. I'll try my luck with the time base though, it's really rough considering I was 2 minutes from my home :-/

surely such a small time over is within the margins of error. your clock / watch could easily have said 955 or something.

Im usually in the "you know the rules and you broke them so tough" but in this instance it seems a little harsh,
You could try writing a letter of explanation although it would probably be like paddling up a certain creek without a paddle.

As long as you were on your way home I dont see a problem being 10mins over, I had quite a few instances where that happened to me when I was a youngin, As long as they could see you were genuine they just let you go home with the "if I see you out again tonight" speech.

Also I think that because he was in "Revenue gathering mode" after dealing with the subaru owner, you probably just copped the raw end of the stick. He had no proof of you speeding, so probably just used that as an excuse to pull you over imo.

This rule is such an arse, how different is 7pm in winter to 10pm in summer?
What is so magical about driving at night?
Instead of implementing proper driver education and training they come up with that shite.
Grown up adults on restricted - what a joke.
Restricted licence should be different: leave no passengers, take time factor out, and put speed factor in.
Like restrict to 90kph on high way. Or maybe restrict the weight of the vehicle. The bigger the weight the bigger the mess.

I think it is a lot more dangerous driving in the rain mid day, than 1.00am on empty road.
It is all because of dumb ass politicians having a go at us.

in my OPINION, it seems like one of those dodgy tickets that they give out where if you contest it you'll get off, but they hope you'll just pay it rather than going to the effort to contest it.

on a similar but totally unrelated note :P, a similar thing happened with me with a parking ticket the other day. I parked and crossed the road to the ticket dispenser where i talked to a friend only to turn around and see a ticket on my windscreen from only being away from the car for 5 mins, the ticket said that i had been parked there for 20 minutes. I managed to get to the parking warden office 5 mins before the time that i had allegedly been ticketed, after 10 minutes of driving. The manager informs me "that the warden got a talking to".

so the moral of that story  is that (again in my OPINION) it kinda feels like sometimes the people that are given the power to enforce the laws sometimes abuse their powers and if we dont contest things they may just keep getting away with it.
I believe that if you were civil and werent doing anything else terribly wrong the cop was a prick.
When in doubt, down and out.

If you're over 25, and do a defensive driving course (3 days theory), then you're only on your restricted for 3 months.

That said though, why should adults not have to go through the same process?

Take for instance, my mother. I've had 3 crashes, two of which weren't my fault, after owning 55 cars, and have been driving for around 9-10 years. My mother has been driving for roughly 35 years, has had 4 cars. She has crashed/scraped her car at least 10 times.. in the last year. She even hit the beer fridge as she was backing out of the garage, and backed into the fence more times than I can remember.

Age does NOT mean experience, if anything it makes for a worse driver due to low spatial awareness and lack of caring/fear for other road users. When you're young and just starting out, you have a huge awareness and are much more focussed on what you're doing, but as you get older, you'll notice that you're much more willing to shoot smaller gaps, run late orange lights, speed considerably, because experience tells you that you'll more that likely get away with it.

Thats so true! My mother is a terrible driver as well

But yeah, get a letter from your boss. I once got pulled up after hours coming home from work (funny enough in a grey ST185 ) It was about midnight (i worked till 11:30, i got my full not much after) and the cop was sweet about it. Just told me if i got pulled up and fined round the corner it wasnt his fault

Yeah, I've written up a letter, I'm going to get my boss to also write a letter confirming the fact that I was on my way home from work. I calculated it on wises, and I was 2.8km away from home, which really annoys me.

Hopefully the two letters will allow me to get off this (in my opinion) bullshite fine.

If I were doing that, I don't think I'd even bother contesting it. I came around a corner, and drove normally, I was cruising at 50km/h in 4th gear when he shined his torch at me and yelled at me to "pull in speed racer". At no point during the course of him being able to see me did I even get higher than 3krpm on the revs.

Yeah, he was. Very arrogant when he told me to turn my car off, and pop the bonnet. He either seemed like he was in a very bad mood, or just wanted to make my night as horrible as possible. I'm just glad I kept a good attitude or he probably wouldve tried to do me for more.

Was quite funny, he had to ask me if my car had a wastegate, and he didn't seem to understand the term "internal" :P. Ahh well, nothing wrong with my car.

On another note, I got a letter from my boss this morning, and it's been sent off to the NZ Police Infringement Bureau along with a letter I wrote out myself. Here's hoping it's a good reply I get back.

Another suggestion... perhaps get your boss to write a letter saying that you were required late that night

Read the whole post Dragger - then you would see that the letter he got from his boss was for exactly that

Yea I agree with you here. After 10pm its actually safer, bugger all traffic on the road.

you can actually get a special dispensation if you are a shift worker, you need to write into LTSA/Police to apply for it, not exactly sure the route you need to go down to get it, but I have seen it written in the law somewhere this can be done.
