Without the alleged aggravating factors such as the condition of the car, and his alleged driving style on the evening in question. He would be looking at maximum 5 years/$20k fine. However with those aggravating factors thrown in, it could be much longer. If he saves the victims and family any more grief an early guilty plea will cut that by 33% though.

We aren't allowed to properly punish criminals in NZ. Sad, but the case. Would be good if this put others off driving around in cars they can't control though. Will be interesting to see how not having a cert will factor into it, not that we will probably get the details.

Trying to keep up with the speed limit in first will be pretty high revs.
Either way, just shows it was a dick move that ended in a kids death.
He knows his cars suspension was uncerted (determined to be unsafe) and wasn't driving to the conditions. If someone came to you with that hypothetical situation, only one outcome would be obvious imo.

The vehicle inspector's report showed Austin's car had been modified suspension "only suitable for a controlled environment like a race track".
Only suitable for a controlled environment? You mean designed to perform rather than for comfort? Am I missing something there? Or wouldn't a race track suspension setup perform (read: handle) better than one designed to soften bumps etc?

like a lot of these road cars with adjustys in them, it probably was running rediculously high spring/wheel rates that are possibly too high even for a track car.

Analogy here: is trying to compete in Paris-Dakkar rally in a stock standard corolla.
Think what happens when you have hard suspension if you go over a substantial bump? it will skip. While the wheel air born you get no traction, no stopping and no steering for that wheel. With softer suspension it will follow all the bumps maintaining traction.
